ADA Title III Lawsuit Numbers Increase in 2019

Seyfarth Shaw LLP reports that the number of ADA Title III lawsuits filed in federal courts by the end of November 2019 (10,206) exceeded the number of such lawsuits filed in all of 2018 (10,163). In a blog post by  Minh N. Vu , the most common complaints include:

  • Braille Gift Card Lawsuits

  • Website and Mobile App Accessibility Lawsuits

  • Hotel Accessibility Information on Reservations Websites

  • Accessible Hotel Room Dispersion

  • Inaccessible Facilities

Minh Vu states in the article “Historically the most prolific category for accessibility lawsuits [is inaccessible facilities and] we have continued to see in the lawsuit filing numbers and in our practice many lawsuits about allegedly inaccessible physical public accommodations facilities such as hotels, retail stores, restaurants, and shopping centers in 2019. We do not expect this to change in 2020.

Take action now to protect your business! Hire a third party inspector to evaluate your properties. Companies who show a pro-active policy of ADA compliance will suffer less in the courts if a complaint is submitted.
