Backyard Discovery Play Set Recalls

The US Consumer Product Safety Commission has issued several recalls for play equipment made or offered by Backyard Discovery, 3001 North Rouse Street, Pittsburgh, Kansas 66762. According to the company website, “Backyard Discovery is a manufacturer of swing sets. It offers swing sets and playsets, playhouses, pergolas and gazebos, patio and home products, and more. The company’s materials are used in residential applications.”

Wooden Play Set

A wooden home play equipment marketed under the brand names Yardline Play Systems (models Turbo Racer, Cloud Racer) and Gorilla Playsets (models Captain’s Fort, Fort Highlander). The playsets include a solid wood roof with a lookout window, slides, swings, a rock-climbing wall and other play features. The photo on the right is representative. Brutus Swing Sets

Sold under the name brands of Big Brutus, Little Brutus and Mini Brutus, these swing sets have been recalled for several reasons. The photo on the right is representative of the Big Brutus swing set. According to the company website, “With consumer safety as our top priority and in keeping with our rigorous quality control standards, we contacted the U.S. Consumer Product Safety Commission (CPSC) and Health Canada requesting a voluntary fast track recall. While we have isolated the issue to Big Brutus swing sets, in an abundance of caution we have decided to pursue a recall of certain Big Brutus, Little Brutus and Mini Brutus metal swing sets.”

The Americans with Disabilities Act (ADA) applies to Title II and Title III facilities, which includes play equipment, but not to play equipment installed at private residential facilities. However, the principles of the ADA can be applied to private residential facilities, including play equipment. In this case, the principles of the ADA for surfaces under play equipment can provide excellent guidance on what types of surfaces provide the safest installations for play areas. SUMMARY: The surface of a play area can be the most important component of the play area when it comes to safety. Whether children are disabled or not, accidents happen at play areas. All children deserve the safest play area possible.
